BELLEVILLE, Ill. (CN) - A St. Clair County judge ordered a lawyer to pay $1.6 million to his former partner to settle a dispute from a $10.5 million settlement with tennis legend Jimmy Connors.
Associate Circuit Judge Andrew Gleeson ordered Edward Brennan to pay the money to Michael Constance, after Gleeson found that Brennan had a duty to disclose that there had been a tender of stock by Connors and that Brennan refused to accept the offer.
The firm of Brennan, Cates & Constance, which dissolved in 1998, had represented Connors in various matters, including his relationship with the proposed Alton Belle Casino, the Madison County Record reported.
In 1992, Connors agreed to pay the partners 20 percent of the money he received in the Alton Belle and Argosy venture. Constance filed a lawsuit against Brennan in 2010, claiming he didn't receive a fair share of the settlement.
"The evidence was clear and convincing that Brennan violated his fiduciary duty and it is equally clear that Constance's failure to collect his share of the Connors fee was based on his reliance on Brennan's statements," Gleeson wrote.
