LOS ANGELES (CN) - A woman claims in court that Kim Kardashian's ex-husband, NBA player Kris Humphries, infected her with herpes during their one-night stand two years ago.
Kayla Goldberg is suing the Brooklyn Nets basketball player for sexual battery in Superior Court, claiming she was infected with herpes after sleeping with Humphries on Aug. 31, 2010.
Goldberg says she met Humphries at the Newsroom Cafe in West Hollywood, where they flirted and exchanged phone numbers. When they met up later at the Trousdale nightclub, he "was openly affectionate" and "promoted himself to her as a charming, trustworthy and caring person," according to the 15-page complaint.
After paying the club tab, Humphries allegedly invited Goldberg back to his room at the Beverly Hills Hotel on Wilshire Boulevard.
"Once plaintiff and defendant Humphries arrived at defendant's hotel room, they had sexual intercourse more than once, becoming intimate partners," the lawsuit states. "During their interactions, defendant Humphries also performed oral sex on plaintiff."
Goldberg claims that Humphries was not wearing a condom "for some of the time during sexual intercourse."
The next morning, they allegedly discussed how many other people Goldberg had slept with.
"Despite his frank and open discussions and questions about plaintiff's sexual life and history, defendant Humphries did not at any time inform plaintiff that he was infected with the incurable venereal disease," the lawsuit states.
Goldberg says she arranged to meet Humphries later that day but never heard from him, and claims he "knew or should have known" that he was infected with the disease.
She says a doctor diagnosed her with herpes on Sept. 8, 2010.
Goldberg is represented by Lori Withrow with Withrow & Betinol of Santa Monica, Calif.
She demands unspecified actual and punitive damages for sexual battery, violation of California Health & Safety Code, negligent transmission of a venereal disease, intentional infliction of emotional distress, fraud in concealment, and fraud in misrepresentation.
Humphries' publicist did not immediately respond to an emailed request for comment, but his representative told E! News that the basketball star does not have herpes.
