UKIAH, Calif. (CN) - A California Highway Patrolman and sheriff's deputies Tasered a man to death for suspicion of stealing a diaper bag, his family claims in court.
Daniel Saulsbery, 39, was Tasered to death on Nov. 26, 2014, when the Highway Patrol and Mendocino County sheriff's officers responded to a call of "the alleged theft of a diaper bag" on Main Street in Point Arena, Mendocino County, Saulsbery's brother and 4-year-old son say in the complaint in Mendocino County Court.
The Highway Patrolman, who arrived first, Tasered Saulsbery for failing to cooperate, according to the Nov. 24 lawsuit. Two sheriff's officers arrived and Tasered him too, the family says.
Saulsbery went into cardiac arrest and died at or near the intersection of Main and Mill Streets.
The family seeks damages for wrongful death, civil rights violations, constitutional violations, failure to train and supervise, negligence, and funeral expenses.
They are represented by Erik Petersen with Krankemann & Petersen, of Santa Rosa.
The defendants are Mendocino County, California, and Does. The officers involved are identified in the complaint as Does.
The Santa Rosa Press-Democrat reported four days after Saulsbery died that police said he had thrown rocks at a man on Main Street and taken his diaper bag.
Citing the sheriff, the newspaper said law enforcement officers had Tasered another man to death in Mendocino County 2010.
