Kickbacks and false claims

BOSTON — A federal court in Massachusetts certified, for interlocutory appeal, a question concerning the proper causation standard at play in claims related to violations of the Anti-Kickback Statute and the False Claims Act. At least two federal courts differ as to whether, if a Medicare reimbursement claim includes items or services related to an Anti-Kickback Statute violation, the claim must also constitute a false claim.
