(CN) - The U.S. Supreme Court on Monday declined to review a challenge to the Army's "don't ask, don't tell" policy of barring openly gay individuals from serving in the military.
Former Army Capt. James E. Pietrangelo II and 11 other veterans challenged the Clinton-era policy, claiming it violated their constitutional rights.
The 1st Circuit in Boston threw out the claims, and Pietrangelo was the only plaintiff to appeal his case to the Supreme Court.
He was dismissed from the military after serving six years in the Army and seven years in the Vermont National Guard, and fighting in Iraq in 1991.
The justices on Monday turned down the case without comment.
