Justices to Assess MD Congressional Districting

WASHINGTON (CN) - The Supreme Court on Monday took up a dismissed challenge to Maryland's congressional districting plan.

Stephen Shapiro, O. John Benisek and Maria Pycha brought the lawsuit at issue against Maryland Board of Elections chairwoman Bobbie Mack and state administrator of elections Linda Lamone, regarding a plan that the Legislature enacted in 2011.

A federal judge in Baltimore dismissed the action and the 4th Circuit affirmed in an unpublished opinion last year because it said the record contained no reversible error.

"We deny Shapiro's motion for oral argument because the facts and legal contentions are adequately presented in the materials before this court and argument would not aid the decisional process," the one-paragraph order states.

The Supreme Court granted Shapiro a writ of certiorari without comment, as is its custom, Monday.
