Jury Awards Woman $4 Million

ST. LOUIS (CN) - A federal jury awarded $4 million to a developmentally disabled woman who claimed she was sexually assaulted by a state employee.

The 24-year-old woman claimed Albert Borders dragged her off and sexually assaulted her while she was a patient at the St. Charles Habilitation Center on Nov. 20, 2007.

Jurors awarded the woman $1 million in actual damages and $3 million in punitive damages, the St. Louis Post-Dispatch reported.

Her attorneys had asked for $10 million in actual damages and $20 million in punitive damages.

There was no dispute that Borders and the woman had sexual contact, but Borders said it was consensual. The woman's attorneys claimed she was unable to consent to sex, due to being mentally incapacitated.
