Juror’s vacation foiled murder conviction

NEW ORLEANS — An appeals court in Louisiana reversed a criminal defendant’s conviction and life sentence for murder, holding the trial court should not have excused a juror to go on vacation after the trial began and replaced her with an alternate. The state says the excused juror disclosed her vacation plans to the court during jury selection, but the voir dire transcript does not show this, and the record shows the first mention of her vacation was two days into the trial.
