CHICAGO - U.S. District Judge Robert Gettleman refused to grant a temporary restraining order blocking Illinois schools from having a legally mandated moment of silence for students, but allowed the lawsuit to proceed.
Radio talk show host Robert Sherman, an atheist, and his 14-year-old daughter sued Gov. Rod Blagojevich and Township High School District 214, where Dawn Sherman is a freshman. The Shermans say the law violates the First Amendment. Blagojevich vetoed the law, which required all schools to observe a moment of silence for reflection or prayer, but the House and Senate overrode the veto.
