Judge Rewrites Racial Issue On Ballot

JEFFERSON CITY, Mo. - A Cole County Judge has rewritten the ballot language on a statewide proposal banning affirmative action, and called the old language "troubling."

Circuit Judge Richard Callahan said Monday that the ballot summary from Secretary of State Robin Carnahan's office was unfair, insufficient and wrongly gave voters the impression that they would be authorizing new kinds of preferential treatment programs if they passed the measure, rather than ending the programs. The ruling came in response to a lawsuit filed by opponents of the measure. Callahan rejected opponents' claims that challenged the ballot measure's cost estimate.
