LOS ANGELES (CN) - A federal judge agreed to voluntarily dismiss Robert Tur's copyright infringement claim against YouTube, ruling that the case was in an early enough stage that dismissal would have little impact on the video-sharing giant.
"While Tur's litigation of this case has been inartful at times, it is still in its earliest stages of discovery," Judge Florence-Marie Cooper wrote.
Tur, doing business as Los Angeles News Service, moved to withdraw his claims because he seeks to join a similar class action against YouTube pending in New York.
YouTube accused Tur of "forum shopping" and vehemently opposed his motion with "personal attacks against Tur and his counsel," the ruling states. But none of those accusations is relevant, Cooper ruled, because YouTube will not suffer legal prejudice. See ruling.
