TEXARKANA, Texas (CN) - A federal judge has called for immediate briefing before he halts the sale of Mynx blood vessel closure devices that infringe on several patents held by St. Jude Medical.
U.S. District Judge Harry Barnes issued the permanent injunction on June 4 against manufacturer Access Closure Inc., but stayed that order pending appeal the next day. Without the stay, the injunction would have been in effect until St. Jude Medical's patent expires in March 2023.
In January, Barnes ruled that Access Closure's devices infringed on at least four of St. Jude patents and awarded more than $27.1 million in compensatory damages for some of the claims. He also rejected Access Closure's counterclaim for declaratory judgment of invalidity and unenforceablity.
The Mynx devices can seal arteries without sutures or implants through the use of a bio-inert sealant that the body dissolved and absorbed within 30 days, leaving nothing behind but the healed blood vessel, according to Access Closure's website.
Access Closure says it remains open for business and is still shipping the devices to U.S. customers.
Barnes set a June 11 deadline for Access Closure's full brief in support of its motion for the stay. That filing is under seal. St. Jude Medical and its Puerto Rican subsidiary have until June 18 to respond.
