Jailed for Three Months for Doing His Job

PHILADELPHIA (CN) - The owner of a junk hauling company claims Philadelphia police threw him in jail for three months after arresting him at a worksite where he was legally removing copper pipes and other metal scrap for a customer.

Damair Dabney said some of his false imprisonment was spent at Graterford, Pennsylvania's notorious maximum-security prison.

Dabney claims he was maliciously charged with burglary, criminal trespass and theft after defendant police Officer Daniel Godlewski arrived at the North Philadelphia worksite in August.

Dabney says he and his business, Junk Bee Gone, had been hired to remove the scrap metal from the residential address where he was arrested.

Dabney says he was released from Graterford about 2 weeks ago, after prosecutors "withdrew the criminal prosecution" against him, having "determined that the listed owner of the subject property was deceased and that he had been deceased at the time of plaintiff's alleged offenses ..."

Damair and his wife sued Det. James Revell, Supervising Philadelphia Police Officer Paul Brown and Officer Godlewski.

They allege false arrest, false imprisonment, assault and battery, intentional misrepresentation, malicious prosecution, abuse of process, and loss of consortium.

They are represented in the Court of Common Pleas by David Nenner.
