Iowa Appeals Court

COMMITMENT, DUE PROCESS - The Iowa Appeals Court upheld the commitment of Daniel Joseph Scott as a sexually violent predator because he was predisposed to commit sex crimes. As a one-legged taxi driver, Scott groped passengers' breasts and committed other sexual assaults. The court also ruled that the state's ability to demand a jury trial and the court's authority to order a retrial in the event of a hung jury do not violate due process.
