DALLAS (CN) - An insurer claims in court that it need not pay the manager of 10 shopping centers the $6 million it demands for damages from a hailstorm.
State Automobile Mutual Insurance Co. sued Dunhill Partners, a commercial real estate firm, in Federal Court.
The insurer claims it's already paid Dunhill more than $1.23 million in claims after the severe hailstorm struck in May 2011.
The damaged properties include the popular Lincoln Square Shopping Center in Arlington's entertainment district, The Shops at Central Park in Bedford, the Southlake Market Shopping Center, Las Colinas Village Shopping Center and the Towne Square Shopping Center in Plano, among others.
State Auto says that Dunhill is claiming additional damages of more than $6.2 million.
"It is State Auto's position that the additional damages being sought by Dunhill Partners were not caused by the storm and/or are otherwise not covered by the policy in question," the complaint states.
Dunhill Partners, founded in 1984, owns and manages more than 4 million square feet of retail properties in Texas, Hawaii and Tennessee, according to its website.
State Auto seeks declaratory judgment.
It is represented by Charles Mitchell, with Naman Howell, of Fort Worth.
