Inmate Loses Challenge To Jail Mail Policy

RICHMOND, VA. (CN) - The Fourth Circuit dismissed a South Carolina inmate's claim that the South Carolina Department of Corrections Maximum Security Unit unconstitutionally banned him from receiving magazines, books and other publications by mail.

Judge Williams said the First Amendment claim is moot, because Lumumba Kenyatta Incumaa, also known as Theodore Harrison, is was released from the maximum security unit, and the ban no longer applies to him. See ruling in Incumaa v. Ozmint.
