Indiana Courts Of Appeal

ELECTIONS - A candidate in Indiana's May 2007 Democratic primary for a seat on the Terre Haute city council lost to his only opponent, who had died. The Indiana Court of Appeals found that the election rules did not allow a substitution of candidate in the primaries, that the caucus process was properly triggered to find a replacement for the opponent and that a replacement was properly selected to fill the vacancy.
