NEW YORK (CN) - The New York State Education Law governing the licensing of pharmacists unconstitutionally discriminates against foreigners, seven Indian pharmacists claim in Federal Court. New York law requires pharmacists seeking licensing in New York to be U.S. citizens or permanent residents.
Pharmacists with legal residency in the United States claim they are ineligible for unlimited, or permanent, licenses based solely on their alien status. They can obtain a limited license that expires in four years.
They claim that unless the statutory provision is struck down, they will be forced to seek employment elsewhere.
