Immigrants Sue Bosses & Attorneys

DALLAS (CN) - An immigrant who lost his job has sued Wendy's International, Café Express which Wendy's owned its attorneys, Boyar & Miller, saying they promised the worker that they would help him get labor certification and deducted money from his paycheck to pay for that promise despite being unable to fulfill it.

The law office assigned the work to an incompetent paralegal and failed to complete the process, exposing the worker to deportation despite years of paycheck deductions, Pedro Cebrian claims in Dallas County Court. He also sues Wendy's International, which owned Café Express during this time.

"Ironically, Mr. Cebrian was fired from his job at Café Express because of the Defendants' incompetence," the suit states. "In August 2007, after [defendants] Lonnie Schiller and Robert Del Grande regained control of the restaurant, the owners of the restaurant chain fired Mr. Cebrian because he had not completed the LIFE Act process successfully. The reason he was unable to complete the process was because of the incompetence and negligence of the Defendants."

Represented by Broome Bobo of Irving, Cebrian seeks punitive damages for legal malpractice, fraud, negligence, unjust enrichment, conversion, and breach of contract.

Here are the defendants: Boyar & Miller PC, Cafe Express LLC, Augusta Foods LLC, Schiller Del Grande Restaurant Group LLC, Lonnie Schiller, Robert Del Grande, Larry Seelig, Wendy's International, Jay Boyar, and E. Michelle Bohreer.

In a similar complaint in the same court, Juan Ortega seeks punitive damages from these defendants: Cafe Express LLC, Schiller Del Grande Restaurant Group LLC, Lonnie Schiller, Robert Del Grande, Larry Seelig, Redstone Private Client Group LLC, The Redstone Companies LP, and Wendy's International.
