Identity Theft

The federal aggravated identity theft statute does not specify if the phrase “another person” includes a deceased person but the “ordinary meaning … is unambiguous,” the Fourth Circuit ruled, finding that the lower court improperly allowed a defendant to withdraw his guilty plea to aggravated identity theft.
