SAN FRANCISCO — The Ninth Circuit dismissed Deschutes River Alliance’s suit challenging the Pelton Round Butte Hydroelectric project, which is co-operated by a utility company and the Confederated Tribes of the Warm Springs Reservation of Oregon. The court found the tribe’s sovereign immunity necessitates dismissal.
