Hospital Blamed for|Nurse’s Sex Spree

MARIETTA, Ga. (CN) - A woman claims in court that a nurse anesthetist sedated her without her consent, sexually fondled her and videotaped it.

D.G. sued Wellstar Health System in Cobb County Court.

Wellstar nurse Paul Serdula was sentenced in April to life in prison plus 25 years. He was convicted in January of seven criminal counts, including unlawful surveillance, sexual assault and aggravated sodomy, according to D.G.'s complaint and Georgia press reports.

Six of his alleged victims filed a class action against Wellstar and Serdula 2 years ago on similar charges. According to Georgia press reports of Serdula's sentencing, he had at least 19 victims, including children.

One of his victims claimed Serdula put his penis in her mouth while she was unconscious, and videotaped it.

In her new complaint, D.G. claims Serdula molested her in 2008 at Wellstar's Cobb Hospital, but she did not find out about it until 2 years later.

"Due to the fact that plaintiff D.G. was entirely unconscious and unaware of what Paul Serdula was doing to her, she had no knowledge or recollection of the events," the complaint states. "It wasn't until on or around November 8, 2010, when the Cobb County Sheriff's Department arrived at her house and informed her of the unlawful surveillance and molestation."

D.G. claims, as did at least six other plaintiffs, that she did not consent to administration of general anesthesia by anyone other than a licensed doctor.

"As alleged in the above-referenced action, Paul Serdula, CRNA, videotaped himself performing heinous sexual acts on each of the plaintiffs listed in the lawsuit, one of whom was a minor child. Defendant Wellstar was deemed negligent and responsible for the horrendous actions of Paul Serdula on his victims," D.G. says in her complaint.

She seeks punitive damages for professional negligence, negligent supervision and premises liability.
