ST. LOUIS (CN) - A man's HIV-positive status does not qualify as an impairment for Social Security purposes, the 8th Circuit ruled. Judge Riley agreed with an administrative law judge and the district court that the petitioner does not qualify for supplementary security income benefits based on his HIV status.
The petitioner "no doubt faces significant obstacles in his work and personal life," Riley wrote.
These obstacles include depression, fatigue and shoulder problems.
A vocational expert states that there were several jobs available in the economy that the petitioner can perform. Also, he was discharged from therapy after skipping several appointments.
