SEATTLE (CN) - A developer says the Seattle Landmarks Preservation Board improperly listed an old Denny's Restaurant as "historic" to block the developer from demolishing the restaurant and building condominiums on the property in the city's Ballard neighborhood.
Plaintiff BCC Mikie Ballard says it submitted an application to the Landmarks Board hoping that the site would quickly be rejected for landmark status. Instead, the Board found that the Denny's "Googie" style architecture, which started in Southern California in the 1960s and was typical for fast food restaurants, should be preserved.
The complaint in King County Court says that the board, "bowing to community pressure," illegally listed the Denny's as a landmark for "sentimental" reasons. Ballard wants the ruling overturned, and damages for "unconstitutional taking."
