High Court Vacates Order on Detainee Abuse Photos

(CN) - The Supreme Court on Monday vacated an appeals court ruling ordering the government to release photographs of foreign detainees being abused by their U.S. captors.

As widely expected, the justices issued a one-paragraph order directing the Manhattan-based federal appeals court to reconsider the American Civil Liberties Union's bid for disclosure of the photos.

President Obama initially backed the release of the photos, but later changed his mind, saying it could put U.S. troops in peril by stirring anti-American sentiment overseas.

The justices ordered the 2nd Circuit to reconsider "in light of Section 565 of the Department of Homeland Security Appropriations Act, 2010, and the certification by the Secretary of Defense pursuant to that provision."

Justice Sonia Sotomayor, a former 2nd Circuit judge, took no part in Monday's decision.
