(CN) - The Supreme Court will not review Connecticut's challenge to the No Child Left Behind Act, which the state says carries an unfunded mandate.
The 2nd Circuit in July had said the suit against Secretary of Education Arne Duncan was premature and should first be determined on an administrative level.
Connecticut had claimed a provision of the act removes the possibility for federal grant money and therefore impermissibly forces states to spend their own money.
