Health care immunity upheld at Wisconsin high court

MADISON, Wis. — The Wisconsin Supreme Court reversed the appellate court’s ruling and upheld a Covid-19 pandemic-era law that extended immunity to health care providers “from civil liability for the death or injury to any individual or any damages” in a broad swath of circumstances, including common law torts such as medical malpractice, wrongful death and negligent infliction of emotional distress. This suspension of liability is permitted by the Wisconsin Constitution and does not violate litigants’ right to a jury trial.
