ATLANTA — An ophthalmologist who falsely diagnosed hundreds of senior citizens with an incurable eye disease in order to get Medicare payments for laser eye treatments was properly convicted on 20 counts of health care fraud, the 11th Circuit ruled .
The court did, however, remand the case for resentencing to comply with the statutory maximum penalty.
