H.S. Principal Was Voyeur, Student Says

LOUISVILLE (CN) - A high school student claims her principal invaded her privacy by showing a surveillance video of her "sexual encounter" with a classmate to an "assembled audience" while making "sexually suggestive comments" about her. The school, believe it or not, is called Male High School.

Plaintiff B.D., who was 17 at the time, claims Male High School Principal David E. Wilson watched her "sexual contact with a male student ... in his office on a monitor connected to a security camera in the cafeteria."

Wilson is now the former principal of Male H.S., according to the complaint in Jefferson County Court.

B.D., who is now 18, claims the sexual encounter happened after the school day ended and she was waiting to be picked up. "Wilson did absolutely nothing to prevent or stop the encounter, instead watching the entirety of the sexual encounter until it was over. He then went to the cafeteria, obtained the children's names, and sent them home without contacting their parents or guardians," according to the complaint.

B.D. accuses Wilson of further invading her privacy by calling several school employees into his office the next day and then playing a video of her sexual encounter for the assembled audience. The suit says the "video clearly showed B.D. and her partially nude body."

The next day, Sept. 3, 2009, Wilson called "several JCPS employees, including faculty and staff," to his office, B.D. says. Wilson had set up five chairs for them and a large projector screen and turned down the lights.

The complaint continues: "Defendant Wilson began playing the video of the children's sexual encounter for the assembled audience. The video clearly showed B.D. and her partially nude body. ...

"(T)hroughout the course of the viewing with employees, defendant Wilson acted as an impromptu narrator of the scene, making sexually suggestive comments as 'Hey, baby, why don't you come over here and grab my pencil' and 'it won't take me long, I am like the minute man.' Mr. Wilson even went so far as to slow down the video playback during a particularly racy moment."

She says the end of the video "clearly shows defendant Wilson entering the cafeteria, after the sexual act had completed, to take the information from both students and send them out of the cafeteria."

B.D. says she suffered "severe injuries as a result of the acts of defendant Wilson."

B.D. also sued Jefferson County Schools Superintendent Sheldon Berman.

She seeks punitive damages for invasion of privacy, negligent supervision, failure to protect from harm, negligence and infliction of emotional distress.

She is represented by Michael Augustus and James Bolus of Louisville.
