MILWAUKEE (CN) — A gun dealer cut to the chase in its second lawsuit in the past year, skipping a jury trial and settling with two police officers shot by guns it sold to illegal buyers.
The Milwaukee County Circuit Court on Thursday took note of Badger Guns' agreement with the officers, one day after dismissing the entire presumptive jury after several days of selection.
A jury found against the now-defunct gun shop late last year in a nearly identical case, but before the court could determine damages the dealer agreed to pay a $1 million settlement to the two wounded officers.
The amount of the current settlement was not disclosed.
While a 2005 federal law protects gun sellers from liability when their wares are used to commit a crime, a jury in 2015 found Badger Guns' behavior fell into an exception of the law: that the seller knew or should have known the guns it sold were being used to commit crimes.
In the 2015 trial, one of the shooters testified from prison that Badger Guns was the place to go if you needed a gun but could not legally buy one.
The seller has a long list of past violations and their license has been under review before, the Journal Sentinel reports.
A Google search lists Badger Guns as "permanently closed," but lists a business called Brew City Shooters Supply, a gun shop and shooting range, at the same address. Its website says it opened in 2012 and lists the owner as Mike Allan, the brother of Adam Allan, who sold guns at Badger Guns until his license was revoked.
The officers in the current case are represented by Patrick Dunphy of Cannon & Dunphy in Brookfield.
