(CN) - School guidance counselors are not entitled to the same protection as teachers under the Wyoming Teacher Employment Law, the Wyoming Supreme Court ruled.
Rebecca Luhm sued the Board of Trustees of the Hot Springs County School District No. 1 in 2006 from wrongful termination from her position as a guidance counselor.
She claimed that she qualified as a continuing contract teacher under the law.
The superintendent wrote her a letter citing budget cuts as a reason for its decision not to offer her a new contract. The school board declined to offer her a hearing.
The trial court ruled in the school district's favor. Justice Golden affirmed the decision.
"The term 'teacher' under the WTEL envisages certified professional employees engaged in the teaching profession," Golden wrote. "Luhm's actual day-to-day activities do not fit within the definition of a teacher.
"A guidance counselor is not a teacher, but rather a certified professional employee who provides auxiliary professional services," Golden added.
