Group Loses Bid to Access NYPD Immigration Files

(CN) - The New York City Police Department has no duty to release data on immigration-related arrests and its communications with federal immigration agencies, because the department doesn't keep those records, a New York appellate division ruled.

The court upheld the denial of a Freedom of Information Law request brought by the Asian American Legal Defense and Education Fund. The fund claimed that the NYPD offered "shifting justifications" for rejecting its FOIL request.

But the appellate court said the department established that, despite "reasonable efforts," the requested information simply wasn't available.
