CLARKSBURG, W. Va. (CN) - A man claims a Walgreen employee defaced photos of his father on his deathbed by drawing vampires, bloody fangs and ghosts on them. He says they were the only adult photos he had of his late father, who clearly was ill in a hospital bed.
Thomas Fincham says he took the photos to the Walgreen's in Waynesburg, Pa. He says he did not look at them "until days after he brought them home. Plaintiff then discovered that someone at Walgreens had cruelly altered the photos, inserting vampires with bloody fangs, skulls, ghost images and other mocking images. These images were superimposed around Plaintiff's dying father, at his bedside, or on each side of him. The person in the photo is clearly in a hospital bed and is visibly ill. The photos are now useless to Plaintiff as a memento and are a non-ending source of emotional damage to Plaintiff."
Fincham demands $25 million in damages for intentional infliction of emotional distress, negligence, conversion and breach of contract. He is represented in Federal Court by Franklin Cornette of Morgantown, W. Va.
