SAN FRANCISCO (CN) - California acted too soon in its attempts to compel the Environmental Protection Agency to allow it to limit greenhouse gas emissions from vehicles, the 9th Circuit ruled.
The court dismissed a lawsuit filed by California, 15 other states and five environmental groups, challenging the Bush administration's alleged refusal to let California enforce its limits on greenhouse gas emissions.
Correspondence from EPA Chief Stephen L. Johnson to California Gov. Arnold Schwarzenegger does not constitute a final order that can be appealed under the Clean Air Act, the court ruled.
Schwarzenegger was joined in his suit by the California Air Resources Board.
