Grandma Sues Landlord|So Her Granddaughter Can Visit

WILMINGTON, DEL. (CN) - A grandmother has sued her apartment complex and landlord for barring her granddaughter from visiting her in her Section 8 housing because the granddaughter had been arrested for a drug offense. Plaintiff Brenda Daniels says the New Windsor Apartments and Arbor Management illegally threaten to evict her if her granddaughter visits.

Daniels' granddaughter's picture appeared in the Wilmington Police Department's "Drug Mugs," a weekly publication that includes photos of everyone arrested the previous week on drug charges. Daniels says the defendants' ban breaches contract and violates Delaware's landlord-tenant law, and that defendants have provided no manner - save this lawsuit - to challenge the ban.

The granddaughter was charged with possession of marijuana, more than a mile away from the Windsor Apartments, and is in a treatment program.

After the Drug Mug was published, Windsor told grandma that if her granddaughter is seen at the complex, Windsor will call the police, have the granddaughter arrested, and will evict grandma.
