Grandfathered Polluters

WASHINGTON (CN) - The Environmental Protection Agency has stayed a grandfathering provision of a rule implementing the New Source Review Program for Particulate Matter Less Than 2.5 Micrometers, in response to an Earthjustice petition for reconsideration.

On behalf of National Resources Defense Council and the Sierra Club, Earthjustice requested that stationary source polluters which had previously submitted applications in accordance with the 1987 policy allowing particulate emissions as large 10 Micrometers, would not be allowed to proceed under the old standards.

The stay will remain in effect until the EPA can hold hearings on the petition.
