Gitmo Prisoner Will Be Tried in New York

MANHATTAN (CN) - A Tanzanian man who has been imprisoned in Guantanamo since 2006 will be prosecuted in Federal Court here, the Justice Department said today. Ahmed Khalfan Ghailani will be prosecuted under a superseding indictment, in line with President Barack Obama's Jan. 22 Executive Order calling for a review of all Guantanamo detainees' cases.

Ghailani was first indicted in December 1998, charged with conspiring with Osama bin Laden and al Qaeda to kill U.S. citizens overseas in the bombing of the U.S. Embassy in Dar es Salaam, Tanzania, on Aug. 17, 1998.

Superseding indictments also accuse him of involvement in the 1998 bombing of U.S. Embassies in Tanzania and Kenya. He was captured in July 2004 and was sent to Guantanamo in September 2006 with other "high value detainees," the Justice Department said today in a statement.

Ghailani will face charges of murder in violation of the Law of War, murder of protected persons, attacking civilians, attacking civilian objects, intentionally causing serious bodily injury, and destruction of property in violation of the Law of War and Terrorism, prosecutors said.
