Funeral, crematory defrauded

TEXARKANA, Texas — A Texas appellate court upheld the lower court’s summary judgment in favor of a funeral home and crematory, which were sued by four sons and their deceased father’s estate for cremating his body without the sons’ consent. A woman representing her as the father’s fiancée signed a form authorizing the cremation, and funeral establishments are immune from suit when they carry out the directions of someone who represents themselves as authorized to decide what happens to a deceased individual’s remains.
