RIALTO, Calif. – An appeals court in California overturned a voter-approved initiative authorizing the city of Rialto to tax fuel wholesalers, finding that it is an impermissible property tax as it is based on a facility’s fuel-storage capacity regardless of whether fuel is actually being stored there.
