KANSAS CITY, Mo. (CN) - Fox News Network and Chris Wallace sued Robin Carnahan for Senate, claiming it "usurped proprietary footage" for a "smear ad" against Roy Blunt, Carnahan's campaign opponent, to make it appear that Fox and Wallace endorse Carnahan.

Fox and Wallace allege copyright violation and misappropriation of persona, in Federal Court.

Carnahan is a Democrat and the incumbent Missouri secretary of state.

Blunt is a Republican congressman.

In the disputed footage, Wallace asks Blunt about his alleged ties to disgraced lobbyist Jack Abramoff.

Carnahan and Fox are also waging this battle on their websites.
