Fox & Candidate Settle Spat

KANSAS CITY, Mo. (CN) - Fox News settled its lawsuit against former U.S. Senate Candidate Robin Carnahan. Fox sued Carnahan, a Democrat, in the middle of her campaign against Republican Roy Blunt, claiming Carnahan used its footage in a campaign ad that made Fox anchor Chris Wallace appear to endorse Carnahan. Blunt defeated Carnahan in November.

"Both sides acknowledge that the political advertisement in question is no longer being used and will not be disseminated in the future," Fox and Carnahan said in a rather ambiguous statement that did not lay blame on either side.

"The Carnahan campaign further acknowledges that the amount and kind of footage used in its 'Clean Up The House' advertisement, as well as the manner in which the footage was used in the advertisement, exceeded that which is permitted," the statement said.

"The Carnahan campaign believed that the campaign's usage was permissible under the copyright fair use doctrine."

Both sides will pay their own attorneys fees, according to a separate filing.
