Florida Courts Of Appeal

JUDICIARY - Defendant moved to disqualify the trial judge on the grounds that his daughter was the supervisor of the two assistant state attorneys working the case. The judge rejected the motion, saying his daughter could not affect the case because she was on vacation. The Florida Courts of Appeal found that the trial judge improperly considered facts that were not in the motion and erroneously tried to judge the truthfulness of the allegations. Reversed.
