Florida Courts Of Appeal

ATTORNEY FEES - The judge of compensation claims ruled she did not have jurisdiction to construe a settlement agreement between the parties to rule on the plaintiff's motion for attorney fees. The Florida Courts of Appeal found that nothing in the settlement precludes a compensation judge's determination of whether the employer failed to abide by the agreement. Reversed. See ruling.

GOVERNMENT, ATTORNEY FEES - A property appraiser was falsely accused of ethics violations by his political opponents, but was denied attorney fees because there was no proof that the accusations were made with actual malice. The Florida Courts of Appeal ruled that proof of actual malice is not required to recover attorney fees. Reversed. See ruling.
