GOVERNMENT - Phantom of Brevard sought a declaration that a county ordinance regulating the sale of fireworks was unconstitutional. The appeals court ruled that the legislature did not intend to pre-empt county regulation of fireworks because if it wished to do so, the legislature would have made the distinction clear. Affirmed.
