ATTORNEY FEES - A homeowners' association sought foreclosure and damages against a woman who failed to pay association fees. Strader, who was included as a defendant because he held interest in the property, filed a counterclaim for $128,000 in attorney fees, claiming the association had a duty to indemnify him. A Florida appeals court ruled that Strader should be able to amend his counterclaim instead of having it dismissed. Reversed. Strader v. Carpenters Crest Owners Association Inc.
