DAMAGES - A Florida appeals court ordered a new trial in a legal dispute between a sightseeing company and the city of Key West. The company claimed the city improperly barred it from operating within 1,000 feet of two competitors that gave the city a cut of their profits. The court found that the $13.5 million damage award to the sightseeing company was incorrectly based on a lost-profit theory of recovery. Key West v. Duck Tours Safari
