GOVERNMENT - The appeals court reversed an administrative law judge's finding that the Department of Financial Services applied an agency rule to the Capital Collateral Regional Counsel without the proper rulemaking procedures. The "rule" at issue - that the Capital Collateral Regional Counsel is part of the executive branch - is really only an opinion, since it did not affect the agency's substantive rights. See ruling.
