COMMUNICATIONS - The First Circuit refused to rehear a recent decision directing the district court to make a primary jurisdiction referral to the FCC on the issue of whether incumbent local carriers may be required to provide access to certain parts of their facilities to other companies at highly favorable rates based on total long-run incremental costs under pricing that the FCC has explicitly rejected.
