WHITE PLAINS, N.Y. (CN) - A waitress says her managers fired her because she refused to take a bribe to let an undocumented kitchen worker use her son's Social Security number. Sheila Everly sued Legal Sea Foods in Westchester County Court.
Everly says that after she rejected bribes and threats from the Boston-based chain's managers, she complained to corporate headquarters and was fired.
She says the restaurant's outlet in White Plains wanted to use her son's Social Security to pay wages to an undocumented alien working in the kitchen.
Conspiracy to commit identity theft carries hefty penalties. In September, a New Yorker who sold 39 Social Security numbers was sentenced to more than 11 years in prison and ordered to pay paid $3.2 million in restitution.
Everly sued Legal Sea Foods, general manager Darleen McNerney and kitchen manager Jamal Washington for wrongful termination and retaliation. She is represented by William Costello with Curan, Ahlers, Fiden & Norris.
