Fifth Circuit dismisses airline passengers’ suit over masking

NEW ORLEANS — The Fifth Circuit upheld dismissal of Delta Airlines customers’ breach of contract, public disclosure of private facts and intentional infliction of emotional distress claims against the airline after they were not allowed to board flights despite documented PTSD preventing them from wearing face masks. The state law claims are preempted by the Airline Deregulation Act and the contract claim does not qualify for a Wolens exception.
